Artist Agreement

PAYMENT: A deposit of 40% is required to secure commission. Once the deposit is paid, the commission is confirmed and terms accepted. This deposit is non-refundable except in case (2). 

In the case (1) of cancellation on the part of the client, the deposit is non-refundable; this deposit can be reallocated to the purchase of other work by the artist, or contribute to a different commissioned project from the artist. If the commissioned work has already been completed, or time and materials have already been used in its creation, the deposit is non-refundable and cannot be reallocated to the purchase of other work by the artist. In case (2), where the artist decides to cancel or fails to complete the project, a refund may be taken into discussion.

Final payment is due once the commissioned work is completed, before delivery. 

ADDITIONAL EXPENSES: Any travel, accommodation, and out-of-pocket expenses relating to the commission will be charged to the client. Expenses include, but are not limited to, public transport tickets, petrol and parking, and hotels. Receipts will be available upon request. The extent of travel (number of sittings) required will be decided approximately and stated to the client. In the case of the artist requiring more sittings than originally planned, the expense will be covered by the artist. All additional expenses are charged to the client in the final invoice. 

TIMEFRAME: The artist guarantees to complete the commission within 24 months of the first sitting, unless agreed otherwise. If the artist fails to show progress or complete the commissioned piece within the agreed timeframe, the client may begin to discuss a refund of the deposit. 

CHANGES AND ALTERATIONS: The client is permitted one round of substantive alterations once the painting is underway. Every additional alteration will add £50 to the final invoice.

By entering this contract, the client acknowledges that they have reviewed other work of the artist and are familiar with the artist’s style. Satisfying the customer is of utmost importance but there are limits to what will be altered at the request of the customer. The Artist will only make revisions that are within the confines of existing style and that do not clash with the mission or vision of the artist. This is for the intent of staying committed to business purpose and brand. 

COMPLETION: Once the project is complete, the client will be notified. The final payment is due before delivery. 

DELIVERY: Once the final payment is received, the finished artwork will be released for delivery. The artwork will be shipped with the courier and shipping insurance of the client’s choosing. The client is responsible for the price of packing and postage once the artwork is ready for delivery. This will be included in the final invoice. The artist guarantees that the artwork will be packaged adequately against damage, however cannot take responsibility for the handling after shipment. If the artwork arrives damaged, the client must contact the artist to make arrangements for return delivery and repair. 

COPYRIGHT AND IMAGE OWNERSHIP: The copyright and image ownership of every original artwork is held by the artist, unless agreed otherwise with the client. The artist holds the right to share any images and use them for promotional, or any other, reasons. 

CLIENT CONFIDENTIALITY: The name, address, or any other personal details of the client will not be shared with anyone outside of the commission agreement. In the case that the artwork is shared publicly, where the client’s likeness is present, no name or other information will be divulged without direct permission from the client. 

RESELL RIGHTS: The artist must be informed of any resale of the purchased work. The artist may be entitled to 15% of any resale within the UK, and 5% of any resale overseas. 

FORCE MAJEURE: Neither party will be in breach of this agreement or otherwise liable for any failure results from events, circumstances, or causes beyond reasonable control; such as sudden illness, natural disaster, epidemic or pandemic, national emergency, war or invasion, and other events beyond reasonable control of the impacted party. Where possible, any prior arrangements affected by an unexpected event will be amended. 

In the case of an illness or injury disabling either party from engaging in organised sittings, the date of sittings will be rearranged and amended when possible. Any expenses encompassing rescheduling travel or accommodation affected by those circumstances will be the responsibility of the party who is affected and requires rescheduling. 

By signing this agreement, all parties agree to the terms as described above. Alterations to this agreement can only be made by both parties and must be placed in writing.
